Practice Emphasis

Ms. Kapp drafts and negotiates design and construction contracts for all players involved in the development, design and construction process. She also prosecutes and defends construction delay, defect and payment claims in litigation and alternative dispute resolution. In addition, she counsels and advises clients on effective strategies for project execution and completion, as well as participating in contract drafting, negotiation, and enforcement.

Representative Clients

In Ms. Kapp's construction law practice, she represents owners, developers, contractors, subcontractors, architects, and engineers. She has represented developers, contractors, and specialty subcontractors in drafting and negotiating contracts for commercial, condominium, residential and shopping center projects, specialty subcontractors in payment and design disputes, contractors and owners in wrongful termination disputes, and owners in payment, defect, design, and delay disputes.

Representative Matters

Ms. Kapp's construction law representation includes:

• The $600 million historic reconstruction of Soldier Field;
• The multi-billion-dollar multi-building development in downtown Manhattan at Ground Zero to replace the World Trade Center;
• The Chicago Spire tower, projected to become the tallest building in North America.

In addition, Ms. Kapp has worked extensively with clients to help negotiate resolutions to conflicts in an effort to prevent the filing of litigation.
